The fight over AI's hunger for power has moved from the grid to the statehouse. From New York to Maine, lawmakers are pushing moratoriums and demanding Big Tech foot the electricity bill.
For the past two years, the story of artificial intelligence in America has been one of relentless expansion, with data centers rising across the country to feed the industry's insatiable appetite for computing power. Now, a very different story is taking shape, as a growing political backlash threatens to slow that expansion in the name of protecting ordinary households.
From the grid to the statehouse
The concern is no longer just whether the electricity grid can physically handle the load. It has become a political question about who should pay for it, and whether communities should have the right to say no. That shift has moved the debate from engineering rooms into legislatures, where elected officials are increasingly willing to act.
At the heart of the issue lies a simple fear: that the surge in demand from power-hungry data centers could push up electricity prices for everyone else. In states where residential energy costs are already high, lawmakers worry that the AI boom could quietly inflate the cost of living for families who never signed up to subsidize it.

This tension has turned a once-celebrated symbol of technological progress into a lightning rod for local politics. The same facilities that promise jobs and investment are now also seen by many as a threat to affordability, and that dual reputation is reshaping how policymakers approach the entire industry.
A wave of state action
The response at the state level has been striking. According to policy trackers, twenty-seven states are now advancing legislation that would require developers to cover their own energy costs and report their usage, with states such as California, Ohio and Utah already enacting laws that go beyond the federal government's voluntary commitments.
New York has moved particularly aggressively. In June 2026, both chambers of the state legislature passed the Responsible Data Center Development Act, placing a one-year moratorium on permits for data centers expected to draw more than twenty megawatts of power, signaling that even a major economic hub is willing to pump the brakes.
The following month, New York's governor went further, signing an executive order that imposed a one-year moratorium on discretionary environmental permitting for data centers expected to draw more than fifty megawatts. Maine, meanwhile, came close to enacting the first statewide moratorium of its kind before its governor vetoed the measure earlier in the year.
Washington enters the fray
The movement has not been confined to the states. In Washington, Senator Bernie Sanders introduced the Artificial Intelligence Data Center Moratorium Act in March 2026, a bill designed to pause construction until strong national safeguards are put in place to protect the public from the risks associated with unchecked AI growth.
A few months later, Representative Alexandria Ocasio-Cortez introduced an identical companion bill in the House of Representatives. Together, the proposals would impose a nationwide halt on building or upgrading data centers with a power demand of twenty megawatts or more until those national protections are firmly established.
Whether such sweeping federal legislation can actually pass remains highly uncertain, given the powerful economic interests aligned behind the AI industry. Yet the very existence of these bills sends a clear signal that the era of unquestioned, frictionless data center expansion may be coming to an end in American politics.
Who pays the bill
Faced with mounting pressure, parts of the industry have tried to get ahead of the criticism. In March 2026, several major data center developers signed a Ratepayer Protection Pledge in conjunction with the White House, committing to cover the full cost of the new electricity generation resources needed to meet their soaring demands.
Critics argue, however, that voluntary pledges are not enough, which is precisely why so many states are now writing those obligations into binding law. The core principle emerging across the country is that the companies profiting from AI, rather than everyday ratepayers, should bear the true cost of powering it.
How this confrontation resolves will help define the next phase of America's AI boom.
